| Section 105 - Employment Eligibility Verification | |

| Purpose: | |
| To ensure compliance with the Immigration Reform and Control Act of 1986 in verifying eligibility to work. | |
| Policy: | |
| Legislation passed by the Congress requires that the College verify the employment eligibility of all new employees, including US Citizens and permanent residents as well as non-immigrants. In order to avoid the substantial financial penalties assessed for violations of this law, it shall be the policy of NDSCS to comply in all substantial aspects with the Immigration Reform and Control Act of 1986. The major requirement of the law is the completion of an Immigration and Naturalization Service Form I-9 for each new employee within three days of the beginning of their employment. The College must verify the identity of the employee and his/her eligibility to work by examining original documents as directed and listed on the I-9 Form. | |
| Procedures: | |
| Verification and completion of the I-9 form for all employees, including work study shall be coordinated through the Human Resources Office, Haverty Hall, Room 120. When an employee is not available to visit the Human Resources Office, due to geographic work location, the immediate supervisor will work with Human Resoruces in identifying solution to getting the I-9 form completed in accordance with the law. | |
| The completed I-9 form shall be maintained in Human Resources. | |
| No payroll forms may be processed and no payroll checks may be issued to new employees until this verification has been completed. | |
