Alcohol and Drug Policy
 
 
 
   
The North Dakota State College of Science follows the North Dakota University System policy and Federal and State laws and local ordinances on alcohol and controlled substances/paraphernalia.
 
Definations
1. "Alcoholic beverages" means any liquid suitable for drinking by human beings, except prescription drugs or over-the-counter medications, which contains one-half of one percent or more of alcohol by volume.
2. "Controlled substance" means any drug, substance or immediate precursor listed in 21 U.S.C. Section 812 and/or NDCC Chapter 19-03 (Narcotics).
3. "Drug Paraphernalia" (NDCC 12.1-31.1) means all equipment, products and materials of any kind which are used, intended for use, or designed for use, in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding converting, producing, processing, preparing, testing analyzing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling, or otherwise introducing into the human body a controlled substance in violation of Chapter 19-03.1.
 
Policy
1. Alcohol: Possession, sale, dispensation, use or consumption of alcoholic beverages upon land or in buildings owned by the Board or its institutions is prohibited, except as provided by this subsection. This policy does not apply to homes furnished to institution officials, family housing, married student housing, faculty housing or off-campus guest housing. Alcoholic beverages may be permitted, subject to applicable state and local laws and ordinances, at events in facilities or upon land owned by the institution pursuant to a permit signed by the institution's chief executive or designee. The permit must describe the nature of the event and the date(s), time(s) and place where consumption of alcoholic beverages is permitted. The permit may be for a single event or for events occurring periodically at the designated place during a period of not more than one year. Alcoholic beverages may not be purchased with public funds.
2. Controlled Substance: Possession, sale, delivery, use or consumption of controlled substances in violation of federal, state and local ordinances, upon land or in buildings owned by the Board or its institutions is prohibited.
3. Drug Paraphernalia: Possession, sale, manufacture, delivery or advertisement of drug paraphernalia in violation of federal, state and local ordinances, upon land or in buildings owned by the Board or its institutions is prohibited.
 
Penalty
Students, staff/faculty and visitors are subject to any and all penalties under state, federal and local ordinances. In addition, students and staff/faculty may be subject to additional penalties on campus.
